1. scope of application

The following General Terms and Conditions of Participation apply to all contracts between F+U Rhein-Main-Neckar gGmbH, Hauptstraße 1, 69117 Heidelberg - hereinafter referred to as F+U - and the participant - hereinafter referred to as the participant - for the educational and further training programmes offered and the accommodation rented out by F+U (halls of residence and host families).
The female form is equivalent to the male form in this document; the male form has only been chosen for reasons of simplification and better readability.

2. general information
Anyone can take part in the educational programmes offered by F+U. If entry requirements are stipulated for a desired qualification, their fulfilment is a prerequisite for participation. The same applies if a subsidy according to SGB III is to be utilised. There is no entitlement to participation. Rooms are only recognised in connection with a
R+U booked training programme.

3. regulations on holidays, public holidays, number of participants
3.1 Lessons cancelled on public holidays will be made up at the end of the course. For planning reasons, a request to make up lessons must be made in writing by 2.30 pm the day before at the latest.
3.2 At the request of the participants, we can also organise the courses if the minimum number of 6 participants is not reached: Lessons can be reduced by 25% if there are 3-5 participants and by 50% if there are only one or two participants. Another group course can be taken to compensate. In exceptional cases, the maximum number of participants may be exceeded; participants are free to take another course at the same level.
3.3 Suspension of the language course (holiday) - The participant has the option of suspending the course for a maximum period of 2 course weeks per 12 weeks within the booked course.

The deadlines for the application are as follows, depending on the course:
a. Intensive courses: per course quarter (12 course weeks) maximum two course weeks (Monday - Friday); application by Thursday, 16:00 at the latest, before the start of the „holiday“.
b. Evening courses: Application by 16:00 at the latest on the day of the course.
c. Individual lessons, closed small groups, company training: Appointments can be cancelled free of charge up to 14:00 the day before at the latest. Appointments on Monday must be cancelled by Saturday at

4 Registration and conclusion of contract
4.1 The F+U Rhein-Main-Neckar gGmbH registration form must be completed for each training programme and each rental of accommodation. With the

4.2 The contract between the participant and F+U is concluded when the registration has been confirmed by F+U in writing by letter, fax or e-mail.

5. terms of payment
5.1 The fees for the contractually agreed services are due upon receipt of the invoice no later than four weeks before the start of the course. All bank charges shall be borne by the participant. If registration is made less than two weeks before the start of the course, the entire fee is due immediately upon receipt of the invoice
5.2 Payment by instalments can be agreed for courses lasting longer than three months. Accommodation can be paid in monthly instalments. Price reductions only apply if the full course or accommodation fees are paid in advance in accordance with the current price list. All instalments must be paid by the end of the course or tenancy at the latest.
5.3 The fees and their due dates are independent of third-party services.
5.4 In the event of late payment, a processing fee of € 2.50 per reminder will be charged. The course participant is free to prove that F+U has incurred no or less damage.
5.5 Exceptions may be made in justified individual cases, which must be made in writing to be valid.
5.6 The invoice amount can be paid in cash, by EC card, bank transfer or by credit card (Visa, Master). Transfers to the following account (always after invoicing):

6 Withdrawal and cancellation by the participant
6.1 The participant may withdraw from the contract up to three weeks before the start of the training programme. The date of receipt by F+U is decisive for meeting the deadline. The notice of withdrawal or cancellation must be received by the F+U administration office, Hauptstraße 1, 69117 Heidelberg in text form.
6.2 If a letter of invitation was issued by the F+U for the German embassy, the following applies: If the visa is not issued, the F+U guarantees the refund of the payment minus any costs incurred, e.g. for postage (e.g. DHL), bank charges and an administration fee of € 200. The course participant has the option of proving that F+U has incurred no or less damage than the aforementioned fees. Rejection must be documented by an official notification and by submitting the original letter of invitation. Cancellation of the language course after receipt of the visa is only possible upon presentation of a document from the German embassy proving that entry into Germany has been waived. If entry into Germany has already taken place, cancellation of the language course is no longer possible (see 6.4.c and 6.8); point 6.4.e applies to room cancellation.
6.3 When booking the „provisional admission“ service, the following applies: The service can only be booked in conjunction with an intensive course of at least 12 weeks. The participant undertakes to provide F+U with all documents required for the application to the university. The application process begins once payment has been received in full and all documents required for the application have been received. Cancellation of the language course after the start of the application process is only possible in the cases provided for by law, in the event of a waiver of entry to Germany and in the event of rejection of the application by the university. Notwithstanding this, points 6.1-6.2 and 6.4.-6.9 apply. In the event of effective cancellation, the participant undertakes a) to provide proof from the embassy that entry to Germany has been waived and b) to submit proof from the university that the place on the course has been waived.
6.4 The date of the start of the course is decisive for the cancellation and cancellation periods for courses and accommodation, if booked. If the course is cancelled, the accommodation is also automatically cancelled. The following cancellation fees will be charged for cancellations less than 3 weeks before the start of the course:
a. Up to one week before the start of the course: € 145 for the course; € 180 for accommodation.
b. Until Friday, 12:00 noon before the start of the course: the course fee for one course week; the rent for 2 weeks plus € 130 administration fee for accommodation; after this period but before the start of the course:
the registration fee plus the course fee for two course weeks or, in the case of individual lessons, the course fee for two individual lessons; the rent for a fortnight plus € 130 administration fee
for the accommodation.
c. After the start of the course, cancellation of the course and the services directly associated with it is only possible in the cases provided for by law. The right to extraordinary
Cancellation remains unaffected.
d. The full course fee must also be paid in the event of non-admission to the course.
e. After the start of the rental period, the accommodation can be cancelled subject to a notice period of six full weeks and the payment of a cancellation fee of € 150.
f. The course participant has the option of providing evidence that F+U has incurred no damage or less damage than the aforementioned fees.
6.5 For external examinations (TestDaF, TELC, TOEFL®, TOEIC®, ECL, TestAS, OnDaF, IELTS, etc.) the cancellation and fee regulations of the respective licensor apply.
6.6 Transfer and other special services (see brochure p. 26) can be cancelled free of charge up to 3 days before the start of the service. After that, cancellation is only possible in the cases provided for by law.
6.7 For all deadlines, the date of receipt at the F+U is decisive.
6.8 Should other notice periods apply due to subsidy measures or other statutory provisions, these shall take precedence.
6.9 The above-mentioned reminder and cancellation fees do not affect the course participant's right to prove that F+U has not incurred any damage or that the damage incurred is significantly lower.

7. data protection
The course participant's personal data is processed and protected in accordance with the statutory data protection regulations, in particular the EU General Data Protection Regulation and the German Telemedia Act (TMG). Information on the type and use of the personal data collected and on cancellation options can be found in the information on data protection, which every course participant can download from the website.

8. duties and benefits of the R+V
8.1 The descriptions and prices in the German and English brochures are authoritative for the scope of the contractual services as well as for the amount of the course fees and the rent. Further translations are for guidance only.
8.2 F+U undertakes to ensure that all skills and knowledge required to achieve the educational objective are imparted; any existing guidelines or examination regulations are taken as a basis for this.
8.3 All F+U language courses are designed for professional, school or academic further education and can also be taken in preparation for a recognised language diploma.
8.4 Instruction is given within the framework of the course programme valid at the beginning of the course. F+U reserves the right to make changes, but the course objective may not be changed.
8.5 If significant changes become necessary before or during the training programme, the participant must be informed of these in writing.
8.6 The change of a teacher or trainer is not a significant change in this sense.
8.7. School certificates and confirmations will only be issued if all invoices or instalments have been paid.
8.8. With the confirmation of enrolment we guarantee a level differentiation of the lessons according to the European Framework of Reference for Languages as follows: A1, A2, B1, B2, C1, C2. Participants must inform F+U of their language level when booking. 

9 Obligations of the participant
The participant undertakes to:
9.1 submit the documents required for determining the admission requirements for the course and admission requirements for the examination in good time and in full,
9.2 to observe the house rules applicable at the place of instruction or residence, in particular not to disrupt lessons, to treat equipment and facilities with care and to follow the instructions of the F+U staff within the framework of the house rules,
9.3 acquire the necessary knowledge and skills to achieve the course objective,
9.4 attend classes regularly and punctually and participate in measures to determine the level of education,
9.5 The regulations of vocational training and school law and the applicable training regulations must be observed,
9.6 to fulfil obligations within the scope of contract measures for third parties and
9.7 to comply with the obligations entered into with this contract. F+U reserves the right to assert claims for damages due to a breach of the obligations under sections 9.1 to 9.7.

10. exclusion and cancellation by F+U
10.1 F+U reserves the right to exclude participants who deliberately or grossly negligently violate Section 9 from the course in whole or in part after prior warning.
10.2 Furthermore, F+U has the right to terminate the contract if the participant is in arrears with the payment of the course fees or rent owed and does not pay despite a reminder. The same applies if an absenteeism quota is exceeded as specified by the immigration authorities (course participants requiring a visa), the joint lessons are repeatedly disrupted or the course objective can demonstrably not be achieved. In these cases, all outstanding payments are due immediately. Fees already paid will not be refunded until the date of cancellation for which the participant is responsible. The participant is obliged to pay the fees by the next possible ordinary cancellation date.

11. other
11.1 F+U accepts no liability for damages incurred by the participant in connection with the conclusion of the contract or participation in a training programme. Compensation for damages in the event of cancellation, postponement or interruption of a course due to a shortfall in the minimum number of participants is excluded. The exclusion of liability does not apply to damages resulting from injury to life, body or health that are based on a negligent breach of duty by F+U or on a wilful or negligent breach of duty by a legal representative or vicarious agent. Fees already paid will be refunded. If material contractual obligations are affected, F+U's liability for slight negligence is limited to the foreseeable damage typical of the contract. Essential contractual obligations are essential obligations which arise from the nature of the contract and the breach of which would jeopardise the achievement of the purpose of the contract, as well as obligations which the contract imposes on F+U according to its content in order to achieve the purpose of the contract, the fulfilment of which makes the proper execution of the contract possible in the first place and on the observance of which the participant may regularly rely.
11.2 Insofar as F+U is responsible for the insurance obligation, the participants are insured against accidents via the administrative employers' liability insurance association responsible for F+U or the responsible accident insurance fund of the federal states, provided that they can provide proof of health insurance. Accident insurance then covers all work-related and commuting accidents in connection with participation in the training programme.

12. cut-off period
Cancellation and termination are excluded if more than six weeks have passed since the reason for cancellation or termination arose.

13. collateral agreements / severability clause
13.1 Amendments to the contract and ancillary agreements must be made in writing to be effective. The same shall also apply to any waiver of the written form requirement.
13.2 Should individual provisions of this contract be or become invalid, this shall not affect the validity of the remaining agreements. The parties undertake to replace the invalid or ineffective clause with a provision that comes closest to the previous provision in terms of the ideas and economic basis of the parties.
13.3 If the contractual partner is a merchant, a legal entity under public law or a special fund under public law, our registered office is agreed as the exclusive place of jurisdiction for all claims arising from or on the basis of this contract. The same applies to persons who do not have a general place of jurisdiction in Germany or persons who have moved their domicile or usual place of residence outside Germany after conclusion of the contract or whose domicile or usual place of residence is not known at the time the action is filed.
13.4. Furthermore, the information on the processing of personal data, the house rules and school regulations as well as the rules of conduct and information brochures handed out apply insofar as they contain rules of conduct.
